Late registration
Late registration procedures are implemented to ensure compliance with K-REACH and in order to export to Korea, an OR (Only Representative) must be appointed to proceed with the late registration.
Late Registration Process
Late registration refers to the process in which a foreign manufacturer or exporter of a previously registered chemical substance uses the same substance information as the original registrant to submit a registration. REACH Chem Song Hyun helps reduce the burden of individual registration and enables companies to meet legal requirements more efficiently.
Companies Subject to Late Registration
Late registration must be carried out by the following companies:
Those intending to export existing chemicals that have already been registered to Korea under K-REACH.
Those who handle the same substances as those registered by the first registrant.
Late Registration Procedures
1. Check Substances Subject to Registration:
Verify eligibility by reviewing the chemical registration information provided by the Ministry of Environment.
2. Appointing OR(Only Representative)
Appoint a person who meets the requirements set forth in the MOE Decree (OR, Only Representative) to perform duties on behalf of the foreign manufacturer or exporter
3. Confirmation of Co-Registration LoA:
Request the purchase of a co-registration right by confirming the LoA of the first registrant.
4. Sharing and Submitting Data:
Prepare late registration documents by utilizing data provided by existing registrants.
5. Application for Registration:
Submit the application for late registration to the National Institute of Chemical Safety for approval.
Precautions for Late Registration
- Late registrants must utilize the data of the first registrant, which must involve usage costs.
- Continuous management and updates of information may be required even after registration.
- Non-compliance with legal requirements may lead to sanctions under relevant laws and regulations.
